DAVID ROEMER,

Plaintiff,

- against -

BOARD OF EDUCATION OF THE CITY SCHOOL DISTRICT OF THE CITY OF NEW YORK, PUBLIC EMPLOYMENT RELATIONS BOARD, HERBERT MONTE LEVY, JOYCE COPPIN, and TOM PAPPAS

Defendants.

Gershon, J.:

Plaintiff moves for reconsideration of this court's Memorandum and Order dated November 6, 2003. The UFT defendant Tom Pappas has filed a response to the motion for reconsideration. The court grants the BOE defendants' application to rest on their prior submissions.

Plaintiff purports to set forth the "matters of controlling decisions" which this court overlooked, see Local Civil Rule 6.3, but in fact points to none which were overlooked by the court. On the contrary, plaintiff is simply making repetitive arguments on issued that were thoroughly considered by the court. Plaintiff also complains that the court's decision "does not always demonstrate in detail that the Court has fully considered" each of the documents filed by plaintiff on the underlying motion. Plaintiff's Mem. at p.2. In fact, the court review all of the documents submitted on the motion; there is no requirement that each document be recited in the court's decision. For these reasons plaintiff's motion for reconsideration is denied.

SO ORDERED,

NINA GERSHON
United States District Judge
