On December 4, 2003, plaintiff moved for reconsideration of the court's order dismissing his claims against defendants. Via letter dated December 15, 2003, plaintiff requested oral argument and/or permission to file reply papers in connection with his motion for reconsideration. The court issued an order denying those requests on December 17, 2003. On January 28, 2004, the court denied plaintiff's motion for reconsideration. Plaintiff now submits a letter, Dated January 27, 2004, which was not received by chambers until January 30, 2004 (although it was received by the pro se office on January 27, 2004) purporting to withdraw his request to submit reply papers on the motion for reconsideration and again requesting oral argument on the motion for reconsideration. Despite plaintiff's stated intention to withdraw his request to submit reply papers, and the court’s order denying his request to do so, his letter of twenty-eight pages is an obvious attempt to circumvent the Court's Order of December 17, 2003. Plaintiff's letter of January 27, 2004, is therefore in violation of this courts order of December 17, 2003. Further violations may subject plaintiff to sanctions.
